| RULES FOR COMPETITIVE EXAMINATION-2011 FOR RECRUITMENT TO THE POST OF
CIVIL JUDGE-CUM-JUDCIAL MAGISTRATE (BPS-18) IN GILGIT-BALTISTAN JUDICIARY |

| Case No. F.9/2/11-CJ-PPE. Please read carefully the Advertisement, and these Instructions for the
Examination before filling the Application Form. Please note that prescribed conditions are not relaxable. |
| 2.The Competitive Examination, 2012 for recruitment to five posts of Civil Judges-cum-Judicial Magistrates
(BS-18), under the Gilgit-Baltistan Judiciary will be held simultaneously at Islamabad and Gilgit for candidates belonging to Gilgit-Baltistan. Both male and female candidates possessing the relevant domicile are eligible. |

| The Competitive Examination shall comprise of two components. |
| (a) Written Examination = 400 Marks |
| (b) Viva Voce |

| 4.Qualification/ Experience: A Candidate must hold at least a Bachelor’s degree in Law from a recognized
University or is a Member of the Faculty Advocates of Scotland and has actively practiced the profession of Law for not less than two years after having been enrolled as an Advocate. (Proof of enrollment and practice required). |
| Explanation: For the purposes of Experience, the expression “practiced the profession of law” shall include
any period of Government service by a person as District Attorney, Government Pleader, Public Prosecutor, Special Public Prosecutor, Additional District Public Prosecutor, Deputy District Prosecutor or Assistant Public Prosecutor on behalf of Government. |

| Age Limits: 22-32 years on closing date. |
| 6.Age Relaxation: In the case of in service Government Servant who has continuously served in connection with
the affairs of the Federal or the Gilgit-Baltistan Government for a period not less than three years, the upper age limit shall be 35 years. Employees of Nationalized Banks, State Bank of Pakistan, WAPDA, Autonomous Bodies and other Semi Government are not eligible for this relaxation. |
| The date of birth accepted by the Commission is that entered in the Matriculation Certificate OR in the7.
Secondary or Higher Secondary School Leaving Certificate. Once a date of birth has been claimed and accepted by the Commission for the purpose of admission to an Examination, no change will be allowed at subsequent Examinations or selections or Certificate of birth from the Principal/ Headmaster of the School from where a candidate has passed his/her GEC, ‘O’ level or equivalent examination, showing the date of birth in the School Admission Register. |
| 8.Domicile: The candidates must submit a Domicile Certificate of Gilgit-Baltistan. The domicile once claimed by
a candidate and accepted by the FPSC for an Examination, no change will be allowed at a subsequent Examination/ selection. The domicile once claimed and accepted at the time of first entry into Government Service shall be treated as final and no subsequent change in his/her domicile will be recognized. |

| Exam Fee: Each application must be accompanied with the original Treasury Receipt (T.R.) of Rs.1500/-
(non refundable). The amount should be deposited in the nearest branch of the National Bank of Pakistan, under the Account Head C02101-Organs of State-Exam Fee (FPSC-Receipt). Cash, postal orders, cheques, money orders or bank drafts will not be accepted. “Blank Treasury Challan” (TR-6) available at FPSC website i.e. www.fpsc.gov.pk can be downloaded. |
| 10.Submission of Application: The candidate must apply on the prescribed Application Form. The Application
Form must be submitted direct to the Secretary, Federal Public Service Commission, Agha Khan Road, F-5/1, Islamabad, on or before the closing date. Any application sent through e-mail/ fax, mail on or before the closing date shall be acceptable if received in the Commission office within three working days of the closing date. An application which is unsigned or is received incomplete or wrongly filled in and is not accompanied with required documents as enlisted in Para-13 will be rejected. |
| 11.For on-line submission of applications, the comprehensive procedure is available on FPSC website
(at link: APPLYING ON-LINE). On-line submission also has the added advantage of confirming that a candidate’s application has been received and registered through a computer generated self printed form which has to be signed by the candidate and dispatched so as to reach FPSC Headquarters within ten days of the closing date otherwise all such on-line application will be rejected, considering the applicants as invalid candidates. | 12.Application duly signed may also be submitted through fax only to FPSC, Headquarters, Islamabad on
Fax Nos. 051-9213386 & 051-9203410. All such Faxes will be treated as provisionally accepted Applications. The candidate is however, bound to submit his/her original application alongwith all necessary documents and T.R. within 10 days from the closing date, failing which his/her candidature is liable to be rejected. |

| 14.Cut off date to determine eligibility of the candidates in terms of age, qualification, etc. is the closing date for
submission of application. On detailed scrutiny of the applications if they are found ineligible, their candidature will be cancelled irrespective of the fact whether they have appeared in the Examination/Test or even qualified therein. On rejection of applicant’s candidature, the applicant would be informed by the Commission defining the reasons of his/ her ineligibility. Decision of the Commission as to the eligibility or otherwise of a candidate for admission to the Examination shall be final. To avoid frustration, the candidates are advised in their own interest to make sure before appearing at the Examination that they fulfill all the requirements of the Rules, relating to the Examination, and are eligible in all respects. |
| 15.Warning: A candidate who knowingly furnishes any particular which is false or suppresses material
information or attempts to influence the Commission, officers or members of the staff of the Commission or to obtain support for his/her candidature by improper means, or deliberately submits forged certificates or tampers with the entries in his/her age and educational certificates, or misbehaves in the examination hall or uses unfair means or is found guilty of misconduct during Medical and Viva Voce Tests may be disqualified for this and/or subsequent examinations/selections held by the Commission and/or criminally prosecuted and debarred from employment under the Government. If appointed, will be dismissed from service as and when the facts come to surface. |

| Departmental Permission Certificate:
(i) A candidate already in Government service including those in the Armed Forces who apply through proper channel should also submit an advance copy of application on prescribed form to FPSC on or before closing date to avoid rejection due to delay that may occur in processing by the Government channels and receipt of application in FPSC. However, Departmental Permission Certificate may be provided within 30 days of the closing date. |
| (ii) Officer/Personnel of the Armed Forces including those on L.P.R. should submit the permission from
Services Headquarters, Ministry of Defence concerned for taking up employment in Govt departments. |
| (iii) Candidate(s) who may have/had left Govt service must submit certificates/evidence from their previous
employers for acceptance of their resignation or termination of their appointments, as the case may be. |

| (iv) Candidate who enters into Government service after submitting the application must inform the Commission
immediately and also submit the Departmental Permission Certificate. If the job of a candidate is changed after submitting the application, the Commission may be informed and a fresh Departmental Permission Certificate should be submitted from the present employer. |
| 17. Correspondence: All correspondence in connection with Applications, (before receiving Roll Numbers) must
quote name of post/ exam applied for, full name of the candidate, father’s name and CNIC number, contact number to facilitate an early response. |
| 18. Any change of address should be reported to the FPSC immediately. Candidates should not write their postal
addresses care of Post Box Number etc. as Postal Authorities do not accept registered letters for such an address. |
| 19. Change of Centre: No request for change of centre will normally be entertained. When a candidate, however,
desires to change his centre, from one indicated in his Application Form for the Examination, he/ she should make a written request to this effect to the Secretary, FPSC, Islamabad and send it by registered post, as soon as possible but not later than 15 days prior to conduct of examination giving full justification as to why he/ she desires to do so. Such request will be considered only on merit. |
| 20. Every candidate for admission to this Examination will be informed, at the earliest possible date, of the result of
his/ her Application. If a candidate does not receive this communication at least 10 days before the commencement of the Examination, he/ she should at once write to the Commission or contact at 051-921 21 59. Failure to comply with this provision will deprive the candidate of any claim subsequently. |
| 21. |
| (i) The written Examination will include the following Papers. A candidate shall answer the Papers in
English or in Urdu. Each paper will be of 100 marks and 3 hours duration:- |

(i) Civil Procedure Code. (ii) Court Fee-Act (with Bare Acts) (iii) West Pakistan Civil Court Ordinance 1962 |
| 3. Islamic Law |
| (i) Islamic Jurisprudence
(ii) Mohammadan Law (Fiqa Hanfi and Fiqa Jaffaria) |
| 2. Criminal Law
(i) Code of Criminal Procedure (with Bare Acts) (ii) Pakistan Penal Code (iii) Qanoon-e-Shahadat order 1984 |
| 4. Major Acts |
| (i) The Gilgit-Baltistan Pre-emption Act 2010.
(ii) Suits Valuation Act. (iii) Contract Act (iv) Limitation Act.(v) Arbitration Act |
| (ii) The object of the examination is to test the ability of the candidates in practical application of law
rather than the range of their theoretical knowledge. For this purpose, the type of questions that will be asked, will be to state facts of a typical case and ask the candidates to frame issues to write a judgment and to discuss the admissibility of evidence. |
| (iii) No candidate will be admitted to the Examination who does no hold a certificate of admission from the
Commission. A candidate who does not appear in first paper will not be allowed to appear in the remaining papers of the Examination. |
| (iv) |
| Qualifying
Standard: |
| (i) 40% marks in each paper.
(ii) 45 % marks in aggregate; and (iii) 50% out of 200 marks in viva voce. |
| Candidates who obtain less than 40% marks in
any of the subjects will not be given credit in that subject. |
| 22.When total marks of more than one candidate are equal, the one who gets more marks in viva voce is treated as
higher in merit. If marks in viva voce are also equal, the one who is older in age is treated as higher in merit. Grace marks are not allowed. |
| 23. |
| The candidates whose candidatures are rejected will not be issued Detailed Marks Certificate. |
| 24.Candidates must use blue or black ink only in their Answer Books otherwise “Zero Mark” shall be awarded.
If any candidate writes his/her Roll No. (except in the space provided for this purpose on the cover of the Answer Book) or writes his/her name or makes any distinguishing mark at any place in his/her Answer Book and/or Additional Answer Books he/she shall be awarded Zero Mark in that paper, besides any other punishment which the Commission may decide to award. |
| 25. Credit will be given for the use of legal phraseology for orderly, effective and exact expression with due economy
of words in all subjects of Examination. The number of Questions required in all subjects to be attempted will only be marked consecutively and the last over-attempted question(s) or Part(s) will not be taken into account. |

| 26. Recounting: Answer Books are secret documents and cannot, therefore, be permitted to be seen by the candidates
or their representatives nor re-examination of Answer Books/Scripts is allowed under any circumstances. A candidate desirous of getting his/her marks, awarded by the examiners re-counted may submit his/her request, so as to reach FPSC within thirty days of the date of issue of Result Card/Marks Sheet alongwith a Treasury Challan of Rs. 200/- per paper as fee for re-counting of marks only. Thereafter, no such request will be entertained. |
| 27. Representation against rejection of candidature, if so desired, may be submitted to the Commission so as to reach
FPSC within thirty (30) days of the issuance of the rejection letter. Representation will be entertained only if accompanied with a Treasury Receipt of Rs. 100/-. The Commission will decide the representation after allowing an opportunity of Personal Hearing to the candidate. The candidate has to appear for personal hearing at FPSC, Headquarters, Islamabad or FPSC, Provincial Offices at his/her own expense. |
| 28. Review Petition against rejection of representation, if so desired, may be submitted to the Commission so as to reach
FPSC within fifteen (15) days of issuance of the rejection of representation. Review petition will be entertained only if accompanied with a Treasury Receipt of Rs.100/- . The decision of the Commission on the Review Petition shall be final. |
| 29. Original Documents: A candidate called for Viva Voce Test, will be required to bring his/ her original
documents, CNIC and Admission Certificate on the date he/ she appears for Viva Voce Test. These will be returned on the spot if found in order. Any document found to have been tampered with, will be liable to be retained and the candidate, liable to be criminally prosecuted in addition to being permanently debarred from the Commission’s Examinations and selections and from Employment under Government. |
| 30. Viva Voce: Each candidate who qualifies the Written Examination will be interviewed by a Board who will have
before them a record of his/her career, both academic and extramural. He/she will be asked questions on matters of general interests. The object of the interview is to assess his/her suitability for the services for which he/she is entered and in framing their assessment the Board will attach particular importance to the moral and ethical qualities of the candidate, his/her intelligence and alertness of mind, his/her vigour and strength of character and his/her potential qualities. The Board will take into consideration his/her extra-curricular activities such as sports, debates, hobbies, etc, and their effect on his/her physique and character, in assessing his/her merit. All candidates are expected to have basic knowledge regarding Islam and Pakistan. |
| 31. Medical Fitness: A candidate must be in good mental and bodily health and free from any physical defect likely
to interfere with the discharge of his/her duties who (after such medical Examination as Government or the Appointing Authority, as the case may be, may prescribe) is found not to satisfy these requirements will not be appointed. |
| 32. Appointment: Success in the Examination confers no right to appointment. Appointment will be made only
after the Govt is satisfied, after such inquiry as may be necessary, that the candidate is suitable in all respects for appointment. In case any serious deficiency is observed in the eligibility of a candidate at any stage, the Commission may cancel his/her candidature and/or withdraw nomination of the ineligible candidate, as the case may be. |
| 33. Reserve List: The Commission will issue its recommendation as per number of advertised post. However,
reserve list of qualified candidates (if available) will be maintained. In case a nominee of the Commission does not join due to any reason, the Commission may revise it recommendation for alternate nominee(s) if so requested by the concerned Department/ Division. Reserve list is not meant for fresh vacancies. Moreover, in case a nominee of the Commission left service after joining, no alternate nomination will be issued, because in such a case, the post shall stand consumed. |
| 34. The Govt sometimes announces public holidays at a short notice. The FPSC examinations/ interviews will not be
affected by such announcements, unless a decision on postponement is conveyed to the candidates. |
| 35. The Commission reserves the right to change the schedule of the Examination as well as to cancel any
paper/papers or the entire Competitive Examination without assigning any reason. |
